Read these Terms and Conditions in their entirety before using libertywellnessandco.com (hereinafter defined as “Site”) The Site and its content are owned by Liberty Wellness and Co LLC. 

 

The Terms and Conditions explained below are to help you understand the layout of our rules, terms, conditions of using/ viewing/ browsing the Site and/or download any resources or product offered on the Site.

“Site, Services, and/or Products” means libertywellnessandco.com, contect, email list, social media posts, blog posts, coaching services, contracts, ebooks, forms, worksheets, website materials available on the Site. 

“Site” means libertywellnessandco.com and any and all of its pages, tabs, sub-pages and “content” as defined herein. 

“You” or “ Your” means the user, customer, or viewer of the Site.

By using the Site you voluntarily agree to act in accordance with, and abide by these Terms and Conditions, our Privacy Policy, and Disclaimer.  You also are admitting that you are at least 18 years of age.    4. We are not in a Practitioner-Client Relationship

By visiting, browsing, downloading or inquiring with us on the contact form, you understand and agree that Liberty Wellness and Co llc and/or Rebecca Stuart or other company employees or contractors  are not your medical providers and do not diagnose, treat, or prescribe. Your activity on the Site does in no way establish a formal relationship with us. This formal relationship is only established after a written contract has been signed, payment for services has been provided, and these actions filed by Liberty Wellness and Co llc. 

You are also not in a formal practitioner-client agreement relationship with Liberty Wellness and Co, Rebecca Stuart, by use of the contact form, email, contacting one of her team members, contact through social media channels or any other means of communications.

   5. This Site and Its Content DO NOT Constitute Medical or Health Advice:

The Information and Content on this Site is not Medical Advice. The information presented on this website is intended for educational purposes only, and it hasn’t been evaluated by the Food and Drug Administration. These links are usually found on different pages on the Site to provide easy access for you to directly access a site that contains information relevant to the content on our Site. We are not responsible for the way they do business and you must understand their terms and conditions, privacy policy, and disclaimers that are separate from ours. We are not responsible for how they may handle your personal information or the accuracy of the content of their Site.

The Site and its content are the sole intellectual property owned by Liberty Wellness and Co llc. This is protected by US Copyright and trademark laws, as well as state intellectual property laws. Violations of this term will be legally pursued to the fullest extent permitted by law.

We agree to allow you a Limited License (“Licensee”) that gives you permission to view, access, download, or purchase items on the Site. This Licensee status is allowed as long as you agree that the Site and its content have been created and written by us after we have made a significant investment of time, money, and education to bring you this content. This Site and all it contains are very valuable to us both in a professional and personal manner and we take the protection of our hard worked for content, very seriously.

By commenting on the Site, or submitting documents to Rebecca Stuart or her team via Liberty Wellness and Co llc via email, social media, you represent you are the lawful owner of those documents and information.

If and when you download anything from the Site you agree and understand you cannot distribute, copy, forward, or share information prohibited by these Terms and Conditions. 

This means if you download or purchase any content from us in a digital format, you may not under any circumstances forward, share (either by email or in person) copy or print out any Content for anyone other than yourself.  You also agree that you will take all necessary steps and precautions to make sure you do not accidentally inadvertently share or distribute materials.

You must request and receive written permission by email (libertywellnessandco@gmail.com) before you share our Site and its content for commercial reasons. You may share for personal purposes, but we ask that you link directly to the Site. Since the Site and its content are not yours, you may not in any way imply or represent that the Site or its content are yours or that you in any way created, caused or contributed to the Site or its Content. You may not make any claims that you are in any way associated with Liberty Wellness and Co llc.

We do not offer any warranties or guarantees of any kind regarding the Site or any of the content associated within it as well as any communications from emails or social media communications represented by Liberty Wellness and Co llc. We do not make any guarantees regarding information utilized personally by the content in the Site. 

 

   16. Your Release of US: 

By using the Site and its content you agree to release, forgive, and forever discharge Liberty Wellness and Co llc, its subsidiaries, employees, agents, contractors, subcontractors, and affiliates from any and all claims, suits, actions, charges, demands, liabilities, damages, judgements, and/or costs, whether known or unknown, both legal and equitable in any manner. 

 

   17. Errors and Omissions Regarding Content

We try our very best to provide current and accurate information in all of our content on the Site including the blog, social media, and email communications. However, due to the constant growth, development and rapidly changing world we can not guarantee such information is free from errors, is accurate or up to date at all times.    18. Arbitration Clause: 

If you have any complaint or should any issue arise in the use of the Site or Liberty Wellness and Co llc content, please contact us directly first by emailing Rebecca at libertywellnessandco@gmail.com.

However, if we are unable to amicable resolve your dispute in that manner, you agree that you and  Liberty Wellness and Co llc shall submit your dispute to binding arbitration with the American Arbitration Association, before an arbitrator that is mutually agreed upon, in accordance with the American Arbitration Associations rules. AAA

By agreeing to this term, you hereby agree and understand that you are waiving your right to a jury trial in court, which would otherwise be available to you if not for this Arbitration Clause. Should any arbitration hearing need to be held, it shall be held within 20 miles of Indianapolis, Indiana.

If the arbitrator issues an award and a judgment is made, the judgment will be binding and will be entered in court. The only award that can be issued to you is a refund of any payment made to Liberty Wellness and Co llc for the applicable service or download. You are not permitted to seek additional damages, including consequential or punitive damages. 

 

   19. Consent to Governing Law 

These terms and conditions, privacy policy, and any dispute arising out of either or both shall be governed by the laws of the State of Indiana. 

   

   20. Consent to Jurisdiction

You hereby irrevocably consent to the exclusive jurisdiction and venue of any Federal Court in the United States District Court for the District of Indiana or a state court located within Marion County, State of Indiana in connection with any matter arising out of these terms and conditions, privacy policy, disclaimer or as a result of your use, download, or interaction from the Site. 

 

   21.Consent to Service

You hereby irrevocably agree that process may be served on you in any manner authorized by the Laws of the State of Indiana for such persons, you waive any objection which you might otherwise have to service of process under the Laws of the State of Indiana.

   23. Limitation of Liability

Liberty Wellness and Co llc is not responsible or liable in any way for any and all damages you receive directly or indirectly from the information you receive from this Site, its content, downloads, social media accounts, blog, email communications, and/or Products. We do not assume liability for damages, lost profits, delays, business losses, business disputes or lawsuits, injuries, harm, death, misuse of or failure to properly use information or documents, due to any act, or failure to act, of you or any business you own or operate, are employed by, or are in any way a part of. In the event you Download anything from our Site we are in no way responsible or liable. 

 

   24.Defense and Indemnification

You shall, at all times, indemnify, defend, and hold harmless Liberty Wellness and Co llc, Rebecca Stuart, and all of our shareholders, officers, members, affiliates, contractors, subcontractors, directors, assignees, and licensees from and against all losses, damages, injuries, delays, deaths, lost profits, and expenses arising out of any proceeding (a) brought by either a third-party or by Liberty Wellness and Co llc and Rebecca Stuart (b) arising out fo breach of your obligations, representations, warranties, or covenants under these Terms and Conditions or the Privacy Policy; and © arising out of any alleged breach said to have been committed by Liberty Wellness and Co. LLC

 

   25. Termination of Your Use

At our sole discretion, we are permitted to terminate your use or access to the Site, Downloads, Products, Services if you abuse, violate or breach any of these Terms and Conditions, or those found in our Privacy Policy, Disclaimer, or any other terms to which you have agreed to.
